GIVEAWAY TERMS AND CONDITIONS

Zagreb, 29.11.2022.

Pursuant to Article 69 of the Act of Games of Chance (OG 35/13, 158/13, 41/14 and 143/14) and the Ordinance on the Organization of Award Games (OG 8/10) PAN-PEK d.o.o. Planinska 2C, Zagreb; PIN 58203211592, hereby adopts the following:

GIVEAWAY TERMS AND CONDITIONS
"PAN-PEK AND DUKAT CHRISTMAS GIVEAWAY"

Article 1 The Promoter

The Promoter of the Giveaway is PAN-PEK d.o.o. Planinska 2C, Zagreb; PIN 58203211592 (hereinafter: PAN-PEK). Support services in the implementation of the Giveaway are supplied by New Level d.o.o., Badalićeva 31, Zagreb, PIN 99200431992 (hereinafter: New Level or Supplier).

Article 2 Promotional Period

The Giveaway shall open on 5 December 2022 and close on 24 December 2022 at PAN-PEK points of sale in the territory of the Republic of Croatia.

Article 3 Purpose of the Giveaway

The Giveaway is organized for the purpose of the promotion of the Promoter.

Article 4 Entry instructions

The Giveaway is open to all natural persons who make a purchase in the minimum amount of HRK 30.00 / €3.98 from any PAN-PEK point of sale in the territory of the Republic of Croatia including at least one product from the product range of DUKAT d.d., Marijana Čavića 9, Zagreb, PIN: 25457712630 (hereinafter: Dukat).

To enter the Giveaway the entrants shall:

• send a text message with the following content: PAN PEK, receipt number, name and surname, address (street and house number, postal code and town/city) to 60777 (HRK 2.40 / €0.32)

or

• fill out the form on the website www.panpek.hr (data that shall be entered: receipt number, name and surname, street and house number, postal code, town/city, mobile number and email address)

The original receipt shall be kept until the end of the Promotional Period and shall be presented at the Promoter’s request when claiming the prize. Each entrant may submit unlimited number of entries with different receipt numbers. Each individual receipt number shall be entered only once. In the event when one individual number is entered subsequently by the same or different entrant, such entry shall be deemed invalid.

Article 5 Eligibility

The Giveaway shall not be open to employees and their immediate families of the Promoter, the Supplier New Balance and their affiliated companies.

Article 6 Prize fund

The prize fund shall consist of:

4 pieces of SMEG Stand mixer, SMF03RDEU, red, each in the value of HRK 5,072.00 / €673.17

4 pieces of SMEG Espresso machine BCC02RDMEU red, matte, cappuccino, each in the value of HRK 5,487.98 / € 728.38

The total value of the prize fund amounts to HRK 39,599.93 / € 5,255.81. The Promoter shall pay 5% of the total value of the prize fund to the Croatian Red Cross.

Fixed conversion rate: HRK 7.53450 = EUR 1

Article 7 Winner selection and notifications

Winners shall be drawn at the premises of the Promoter and according to the following schedule:

• 12 December 2022 - for entries made between 5 December and 11 December, 2 winners shall be drawn and awarded stand mixers
• 19 December 2022 - for entries made between 12 December and 18 December, 2 winners shall be drawn and awarded espresso machines
• 27 December 2022 - for entries made between 19 December and 24 December, 4 winners shall be drawn (2 for stand mixers and 2 for espresso machines)

Winners shall be drawn using a computer application and random number generator.

One person is eligible for one prize. In the event when during the prize draw the winner is drawn multiple times, the prize draw shall continue until all prizes are awarded to different natural persons.

The prize draw shall be supervised by a three-member commission and a record of the prize draw shall be kept. The commission shall verify if the winner complied with all the rules set out in Terms and Conditions herein. In the event when a drawn winner is declared invalid, the prize shall be awarded to the next eligible entrant drawn.

Article 8 Claiming prizes

The prize is not redeemable for cash. All obligations of the Promoter with respect to the winner shall terminate after the prize is claimed. Winners shall be notified within 8 days from the prize draw. Winners shall claim the prizes within 30 days from the date of receipt of the prize notification. They shall be required to present personal identification document in order to claim the prize.

Winners shall claim the prizes at PAN-PEK store of their choice, in agreement with the Promoter.

If winners fail to claim the prizes within the stipulated deadline, they shall be notified of the prize again and they shall be granted a 15-day deadline to claim the prize, starting from the date of receipt of the additional notification. If the winner is prevented from claiming the prize personally, he/she may authorize another person to claim the prize on his/her behalf. The authorized person shall be required to present personal identification document in order to claim the prize. If the winner is a minor, the prize shall be claimed by his/her parents or legal guardians, who shall be required to present personal identification document in order to claim the prize.  

In the event when fewer entries are made in giveaway than the number of prizes provided for in the prize fund, the number of prizes awarded shall equate the number of entries. Unclaimed prizes shall be proceeded with in compliance with the Act of Games of Chance (OG 35/13, 158/13, 41/14 and 143/14) and the Ordinance on the Organization of Award Games (OG 8/10).

Article 9 General provisions

The Promoter shall not assume responsibility for incomplete, incorrect and late entries. The Promoter and Giveaway entrants shall not accept any responsibility for any damage that might arise from the prizes or benefits.

The Promoter reserves the right to cancel, terminate or temporarily suspend this Giveaway only in the event of unforeseen circumstances outside its reasonable control, which could not have been prevented, removed or avoided. Entrants shall be informed of the termination of the Giveaway on the official website www.panpek.hr. In the case above, the Promoter shall not be liable for any damage incurred to the entrants.

The Promoter’s decisions on all issues with respect to the Giveaway and the application of the Terms and Conditions herein is final and binding for all participants.

Article 10 Publication of Terms and Conditions

The Giveaway Terms and Conditions, including class number, reference number and the date of issuance of the approval of the Ministry of Finance, shall be published on the official website www.panpek.hr prior to opening of the Giveaway.

Article 11 Personal data protection

By participating in the Giveaway, i.e., by filling out the online form or sending the text message, the entrants consent to the Terms and Conditions herein and thereby authorize the Promoter to collect and process their personal data for the purpose of the organization of the Giveaway.

Data controller is PAN-PEK, d.o.o., Planinska 2C, Zagreb, PIN 58203211592. Data processor is New Level d.o.o., Badalićeva 31, Zagreb, PIN 99200431992.

Entrants may withdraw their consent to the processing of personal data in written form to the Promoter’s address and thereby lose the right to further participation in the Giveaway, including the right to the prize. Personal data of the entrants shall be stored for 120 after the completion of the Giveaway, after which they shall be destroyed, with the exception of the personal data required to announce winners and the personal data entered into the Prize draw record. The personal data of winners may be shared with providers of postal or courier services for the purpose of prize delivery.

The Promoter shall undertake all reasonably necessary measures to ensure that the personal data of the entrants are used and processed in a secure manner and in compliance with the applicable legislation.

Article 12 Validity of complaints

All complaints shall be processed by the Promoter. Where the complaints are founded, the Promoter shall undertake to remedy the failures and notify the entrant accordingly, and if necessary, inform all other entrants.

The Municipal Court in Zagreb shall have exclusive jurisdiction in relation to any dispute that might arise between the Promoter and entrants.
